Abstract
Justices agreed to hear a case that challenges legal theory behind the 2018 federal bid-rigging conviction related to steered state contracts of Louis P. Ciminelli, the former CEO of a once high-profile Buffalo construction firm, and those of other developers and officials involved in the ‘Buffalo Billions’ development pay to play scheme. Justices will weigh prosecutors use of the 'right to control' theory. The jury verdict endorsed a 'right-to-control' theory of wire fraud. The U.S. Supreme Court decision. The case will be heard on July 3, 2022.
