The Dotted Line: Virginia bans 'pay-if-paid' contract language
Abstract
Virginia joins a handful of states that have some type of statutory ban on a common, but controversial, legal term of art in construction contracts. Just six other states have laws that explicitly make pay-If- Paid clauses unenforceable by statute. When SB550 goes into effect in Jan. 1, 2023, Virginia will be the seventh state to have such a statute. The ban will go into effect. WhenSB550 will go in effect on Jan.1, 20 23, the ban will be in effect.
